Terms and Conditions for Internet Access Services

This document represents the complete agreement and understanding between Great Northern Technologies, Inc., its affiliates, subsidiaries, and assigns (hereinafter "GNTech") and Customer and supersedes any other written or oral agreement. Upon notice published on-line via GNTech, GNTech may change these terms and conditions, and/or change the prices charged for these services, and/or discontinue or change the services offered.

Account and Agreement Term

This agreement shall remain in effect until Customer terminates his/her account or GNTech cancels Customer's account. GNTech may occasionally require new registration and account information from Customer to continue this service. In addition, Customer shall notify GNTech in writing or by electronic mail (e-mail) of any changes in the account information, such as address or phone number.

GNTech reserves the right to change the terms and conditions by notifying Customer in writing or by e-mail at least 30 days in advance of the effective date of the change. Use by Customer after the effective date constitutes acceptance of the new terms and conditions. If Customer does not agree to the new terms and conditions, Customer may cancel this agreement at any time by canceling their service.

GNTech also reserves the right to terminate an account or individual services provided in that account at any time for any reason. Customer will receive a refund for any prepaid but unused time unless in breach of this agreement.

Billing/Terms/Termination

GNTech will bill Customers subscription and connection fees as set forth in GNTech's current rate schedule. This schedule may be modified by GNTech at any time by e-mail to Customer. Customer may change their billing schedule or discontinue their service at any time.

The GNTech accounting period is monthly. Customer will be billed according to the monthly anniversary of the service.  If payment is not received within 5 days of the expiration date of service, then that service may be suspended and and $20.00 fee may be accessed to reactivate that service.  There is a $25.00 service charge for each returned check.

Termination of services must be made on line by the customer using their account that is set up at www.MirageShopping.com. If payment is not made, customers will be automatically suspended.  Customers will not receive full or partial refunds for purchased service no matter what time they terminated their account.

Provision of Services

GNTech will provide services on its host computing systems to individual customers in exchange for payment of fees and compliance with the terms and conditions of this document. GNTech services are defined as the use by Customer of computing, telecommunications, software, and information services provided by GNTech. These services also include the provision of access to computing, telecommunications, software, and information services provided by others via the world-wide computer network known as the Internet.

Web Space Use

Customer warrants that it shall not use their web site in violation of any law or regulation, including, but not limited to, rights of privacy or publicity, prohibitions of libel or slander, and violations of defamation, infringement, misappropriation, intellectual property right laws, invasion of privacy, unfair competition, anti-discrimination, consumer protection, credit, false advertising, obscenity, pornography, indecency or tax laws, or the Electronic Commerce Privacy Act and the Computer Fraud and Abuse Act. Customer understands that any criminal use or threatened criminal use of their web site by Customer may be referred to an appropriate governmental agency and may result in termination to protect other Internet users. Some materials may be offensive to some customers. GNTech reserves the right to remove or request the immediate removal by Customer of any materials considered, at the sole discretion of GNTech, to be offensive.

Security of Accounts

GNTech dial-in service is for individual users and Customer therefore agrees not to share the password of the account with others, including but not limited to other family members or business associates. Customer acknowledges that GNTech may terminate the account without notice if the Customer does not comply.

GNTech does not and will not share any account information including email addresses with any third parties.

Customer agrees to maintain a secure password to the account.

Customer agrees not to use any GNTech services to obtain the passwords of customers on GNTech or other systems. Customer agrees not to use any GNTech services to make unauthorized attempts to access the systems and networks of others.

GNTech agrees to respect the privacy of Customer's personal files and email. GNTech reserves the right to monitor Customer's actions when necessary to help Customer or to protect other GNTech users and systems.

Use of Material

Customer agrees not to use GNTech service to violate copyright or other intellectual property rights of any author or publisher. For example, Customer may not upload or download commercial software in violation of software license agreements.

Abuse of Internet Services

Customer agrees to use the services provided by GNTech as permitted by applicable local, state, and federal laws. Customer agrees, therefore, not to use these services to conduct any business or activity or solicit the performance of any activity that is prohibited by law.

Customer agrees to maintain their computer in a reasonable manner regarding viruses, worms, and other such programs that could damage GNTech's ability to deliver services.  GNTech reserves the right to disconnect or block Customers from using their service with GNTech instantly without prior notice.

Customer agrees to refrain from mass posting of the same message to many inappropriate Usenet newsgroups (spamming). Customer agrees to refrain from mass, unsolicited e-mailings. Customer agrees to post advertisements only where appropriate and other venues that specifically encourage or allow advertising. Customer agrees to respect the conventions of the newsgroups, lists and networks to which the Customer is posting, including rules more restrictive than but not limited to the above.

Customer may be liable for damages caused to GNTech including but not limited to infringement tracking, troubleshooting, logging, and system analysis at $100 per hour and/or $100 per incident.  

Customer agrees to abide by GNTechs interpretation of the above. If Customer needs help interpreting or applying these rules, Customer should ask GNTech support staff (support@gntech.net) for assistance.

Abuse of GNTech Services

Any use of GNTech system resources that disrupts the normal use of the system for other GNTech customers is considered to be abuse of system resources and is grounds for administrative intervention. Some examples of system abuse include spawning dozens of processes, consuming excessive amounts of memory or CPU for long periods of time, and staying attached to modems while not really "active" on the line.

Depending on the nature and the severity of the abuse, the user may receive an e-mail warning, have their processes halted, or have their account suspended. If the misuse is unintentional, the suspension may be rescinded following discussion with GNTech management and correction of the infringement. If the misuse is intentional, the suspension may be rescinded at the discretion of the GNTech management, and may require the payment of a reconnection service charge.  If the misuse is intentional, Customer may be liable for damages caused to GNTech including but not limited to infringement tracking, troubleshooting, logging, and system analysis at $100 per hour and/or $100 per incident.  Occasionally, unintentional misuse is misclassified as intentional misuse. Customers who believe their activity has been misclassified may appeal to the GNTech management.

Discovering and Reporting Abuse

Violations of the GNTech conditions of use are considered unethical and may in some cases be criminal offenses. Customer is expected to report to GNTech any information concerning instances in which the conditions of use have been or are being violated. When GNTech becomes aware of possible violations, GNTech will initiate an investigation. At the same time, in order to prevent further possible unauthorized activity, GNTech may suspend access to services to the individual account in question. Confirmation of violations may result in cancellation of the individual account and/or criminal prosecution. The account cancellation may be rescinded at the discretion of the GNTech management, following payment of a reconnection charge.

GNTech considers user information and activities as confidential in general. However, GNTech reserves the right to monitor Customer's actions when deemed necessary to troubleshoot connectivity problems or determine if there are violations of use.

Offensive or Adult Materials

GNTech exercises no control over the content of materials accessed through GNTech. Some materials may be offensive or adult in nature and the parent or legal guardian of Customers less than 18 years of age will be responsible for monitoring and controlling such access. GNTech will NOT be controlling access to such materials for Customers less than 18 years of age. Customer agrees that GNTech has no obligation to Customer, undertakes no responsibility for any content transmitted by or to Customer, and has no responsibility to review the content transmitted by or to Customer to determine whether any content may incur liability to users or third parties.

Equipment Maintenance and Downtime

Routine maintenance is a necessary part of maintaining quality Internet service. Therefore, GNTech will perform routine system upkeep maintenance during early morning hours when necessary. GNTech will provide customer notification via e-mail 24 hours prior to scheduled routine maintenance. Customers are not entitled to a refund for any downtime of the system.

Limitation of Liability

GNTech provides its services "as is" and makes no warranties of any kind, whether expressed or implied, for its services. GNTech specifically disclaims, without limitation, any implied warranties of merchantability, fitness for a particular purpose, or noninfringement. GNTech will not under any circumstances be responsible for any losses or damages resulting from delays, nondeliveries, misdeliveries, service interruption, use of software, viruses, system corruption, performance, nonperformance, termination, breach, action or inaction, or Customer's negligence, misconduct, errors or omissions.

GNTech will not under any circumstances be responsible for loss of profit or revenue, or for any direct, indirect, consequential, incidental, special, punitive, or similar or additional damages whatsoever, including without limitation, damages for loss of business profits, business interruption, loss of business information, and the like, arising out of the use of or inability to use the services provided hereunder, even if GNTech has been advised of the possibility of such damages. Customer agrees that its sole remedy in event of any breach of this agreement shall be a refund of fees paid to GNTech. In no event shall the cumulative liability of GNTech under this agreement exceed one month's total payment paid by Customer to GNTech hereunder.

Jurisdiction

The validity, construction and performance of this agreement shall be governed by the laws of the State of Washington.

Severability

If any provision of this agreement is held by a court of competent jurisdiction to be contrary to law, the remaining provisions of this agreement will remain in full force and effect.

Effective date

Use of the GNTech system presumes you have read the agreement in its entirety, and you agree to the terms and conditions contained therein. You also certify that you are more than 18 years old, and do not require the signature of a parent or legal guardian.
